If you wake up the morning after a one-night stand with a little something more than a hangover, should you able to sue the person who slapped you with that nasty case of crotch cooties? A 56-year-old woman in Riverside County, Calif., was recently awarded over $7 million after contracting genital herpes from a partner, a 77-year-old man who had genital herpes for over 25 years and failed to mention it.
The man also failed to use a condom, so now the woman has genital herpes, too, and said she was denied health insurance after contracting the sexually transmitted disease.
This isn't the first time the STD has infected the court system -- celebs from Michael Vick to Robin Williams to David Hasselhoff have been sued for passing along the disease.
Call us crazy, but isn't it the responsibility of both partners to insist on safe sex? And for $7 million, couldn't you live with some occasional itching and burning?

Wow, this free love stuff is really great, huh?
I cannot believe anybody would give her a dime, much less $7 million. The consequences of poor choices and irresponsible sex can be lifelong and painful. Unpopular though it may be, she made the choice to have sex outside of its intended boundaries, and without the proper protection.

Do not have unprotected Sex until both of KNOW what you have or don't have. SEX IS A GAMBLE AND CAN BE DEADLY IF YOU ARE ON THE LOSING END. My friend & coworker married a guy who was HIV positive and knew it. He did not tell her because he wanted to marry her and be on her insurance. She found out 6 months later when they both went for a check up and requested testing for "everything" HIV test was positive and he tried to blame her BUT they could tell who gave it to who....SAD WORLD. A family member just one found out by chance that they have HEP C....testing showed spouse has it too. They have been together 20 years and have been (as best you can tell) faithful.... they both had lived the single lifestyle a number of years before marriage so YOU NEVER KNOW what can be lurking and when it can rear its ugly head. To the person who thought I was wrong about her not getting this money just because it says she was awarded the money doesn't mean she actually has it in her bank account. It only means she was awarded it. He has to have the money in order to pay her.
I doubt he has this money or he could have afforded a condom. Not that she wasn't wrong herself in not having protection but even if they both had protection a person can still get Herpes while using a condom.

And adults say kids are morally corrupt! Hello people, it is not life threatening. Next will be commercials "If you've been infected by a one night stand, you may be entitled to compensation." The lawyers will have a field day. Lets tie up the already overloaded court system on this crap. She will not be in pain "for the rest of her life". She will experiance occasional out breaks. Unpleasant to be sure, but that is the price she will pay for being idiotic. I have never heard of a person being denied health insurance due to herpes. If that is the case, this company must deny anyone with a cold sore, because that too is a herpes virus. Aids is a totally differenent, and life threatening disease, so try not to get the two confused. As for Robin, Marguerite and the like....sigh, as they say, ignorace is bliss.

The problem with sueing over this type of situation is that the man that gave it to her had to get it from someone. Should he sue that person and should that person sue the person that gave it to them, etc...? There would be tons of cases going to court clogging up our court systems. When you have sex with someone you are putting yourself at risk for this type of situation to happen. Especially when you are having one night stands. Either take precautions or don't sleep around. It's that simple.

I'm 60. Girlfriend is 59. Proffesional woman, collage educated, active in her community........just recently seperated from a nine year relationship (supposedly monogamous)...........she gave me Herpes. I guess the demographics have changed. Your chances of getting herpes from a senior citizen are a lot higher these days then you'd ever guess.

Some of you people can't read! It says she had it for 25 years! That means she had it when she was 31 and he was 52... But I do think it is nonsense that the judge awarded her with so much money. You should always practice safe sex unless you are married or fully committed to another person.

She will see this money, you might have missed the 1 small sentence that said that she was awarded the 7 mil. I can see suing for damanges.... but THAT much... yeesh, maybe a few thousand to cover medical bills and not being accepted to health insurance... but 7 million? WAY too much...
You are wrong, just because someone was "awarded" damages does not mean it will get paid. If the man cant pay, then he will always have a judgement against him, and until its paid, he wont be able to buy a home, etc.

Don't make fun of this. Genital herpes is not just a little 'crotch itching'. It is horrible and not only that it can spread, and even make you more susceptible to other STD's. AND it's a lifelong things. No matter who you are with, you had better make sure you know their history or use protection. As we see, even 77 years of age doesn' t make a person monogamous for decades. I agree both partners should take responsibility, but at 77, him knowing about it for more than 20 years, he should at least have told her about it and given her the choice. Hey, she most likely would have chosen to pass. I know I would have. SO DON'T JOKE ABOUT THIS!
